Crackerjack Air Pros Subscription and Equipment Agreement 1. Subscription Term 1.1 The initial subscription duration is 12 months from the start date ("Initial Term"). 1.2 After the Initial Term, the subscription will continue on a month-to-month basis with no commitment, until canceled by either party in accordance with this agreement. 2. Equipment Provided 2.1 As part of the subscription, Crackerjack Air Pros provides a Nest thermostat ("Thermostat"), monitoring sensors, and a monitoring hub ("Monitoring Equipment"). 2.2 The Thermostat is valued at $299.88. It is billed at $24.99 per month for the duration of the Initial Term. After 12 months of paid subscription, the Thermostat becomes the property of the subscriber. 2.3 The Monitoring Equipment is provided for use during the subscription and remains the property of Crackerjack Air Pros. 3. Payment Terms 3.1 The subscription fee for the Initial Term is $24.99 per month. 3.2 After the Initial Term, the subscription fee will be billed monthly at the prevailing rate, currently $24.99 per month, unless notified otherwise. 4. Cancellation Policy 4.1 Subscribers may cancel their subscription by contacting Crackerjack Air Pros customer service. 4.2 If the subscription is canceled before the end of the Initial Term, the subscriber will owe the remaining balance for the Thermostat. This balance is calculated as $24.99 multiplied by the number of months remaining in the Initial Term. For example, if canceled after 5 months, the subscriber owes $24.99 x 7 months = $174.93. 4.3 After the Initial Term, subscribers may cancel at any time without further obligation, except as specified in this agreement. 5. Return of Monitoring Equipment 5.1 Upon cancellation, subscribers must return the Monitoring Equipment. 5.2 Crackerjack Air Pros offers a no-cost pick-up service for the Monitoring Equipment. Alternatively, subscribers may return the equipment by their own means. 5.3 If the Monitoring Equipment is not returned or pick-up is not arranged within 14 days of cancellation, a non-return fee of $250.00 will be charged. 6. Ownership and Use of Equipment 6.1 The subscriber gains ownership of the Thermostat only after the completion of 12 months of paid subscription. 6.2 The Monitoring Equipment remains the property of Crackerjack Air Pros at all times and must be returned upon cancellation of the subscription. 7. General Provisions 7.1 Crackerjack Air Pros reserves the right to modify the terms and conditions of this agreement with prior notice to the subscriber. 7.2 This agreement is governed by the laws of the state in which the subscriber resides. Any disputes arising from this agreement shall be resolved in the appropriate courts of that state. Acknowledgment and Agreement By subscribing to Crackerjack Air Pros, the subscriber acknowledges that they have read, understood, and agreed to the terms and conditions outlined in this agreement.
